Santa Clara County prosecutors said today they do not have enough evidence to file charges against Benjamin David Calderon, whom Gilroy Police arrested Oct. 30 in relation to a fatal shooting at a Gilroy city councilmember’s home.

Campbell police said officers responded at about 10:45 a.m. Nov. 2 to reports of a shooting and a person down in the roadway on the 300 block of W. Sunnyoaks Avenue, where they found a male victim suffering from at least one gunshot wound. He later died in the hospital.

Efrain Anzures, 27, and Alfred Castillo, 26, are in custody following the shooting reported at about 3:40pm Sunday in the 5200 block of Great Oaks Drive, where officers arrived and found a man suffering from at least one gunshot wound.

Two men have been charged with hate crimes in Santa Clara County for separate assaults against an Asian American woman walking her dog in Los Gatos and a 93-year-old Persian American in San Jose. According to a press release today by the Santa Clara County District Attorney's Office, Richard Hanford, 62, of Los Gatos, told an Asian American woman: “This is America, (expletive deleted)” before striking her on a sidewalk in Los Gatos. David Greenburg, 56, of Redwood City, spit at an elderly San Jose Persian American man and told him: “Go back to your (expletive deleted) country.”

Both are charged with misdemeanor hate crime charges.

A 19-year-old cousin of Gilroy council member and prominent Santa Clara County Democrat Rebeca Armendariz was arrested in connection with a Halloween party shooting outside her home that left an 18-year-old dead and three other teens injured.
