The men were indicted by a federal grand jury in San Francisco for conspiracy to commit robbery, conspiracy to commit kidnapping, attempted robbery, and attempted kidnapping.
DNA evidence tied Thomas Loguidice, 67, to a 1994 mall robbery, while he was serving a 40-year sentence in state prison after being convicted in 2012 of continuous sexual abuse of a child under 13 in San Benito County.
Yesenia Ramirez Jose Portillo had pleaded guilty in August to eight charges including kidnapping, attempted kidnapping, conspiracy, burglary, and vehicle tampering, for cutting the brakes on Baby Brandon’s mother’s car. They both faced a maximum prison term of 16 years and four months.
District Attorney Jeff Rosen objected to the judge’s decision to give Yesenia Ramirez and Jose Portillo less than the maximum prison terms in exchange for their pleas, without a separate sentencing hearing.
Jose Portillo and Yesenia Ramirez were charged with kidnapping in Santa Clara County Superior Court today and are being held without bail. A third suspect arrested on April 26, Baldomeo Sandoval, was released from custody and will not be charged, police said.
At a press conference late this morning, San Jose police said the three suspects in custody have some connection to the family of kidnapped 3-month-old Brandon Cuellar, taken from his home Monday afternoon.
