10 Biggest Takeaways from the Mike Honda Ethics Probe Report

Mike Honda has a huge problem. The ethics investigation into the eight-term congressman continues, and details released in hundreds of documents Thursday suggest his staff viewed official business as a commodity to be sold in exchange for campaign support. There’s also the issue of House staff routinely doing campaign work on taxpayer time.

The congressman may have no choice but to burn through campaign dollars for top-notch attorneys to make an embarrassing defense: The congressman shouldn't be blamed for any violations because there was a lack of institutional control.

The arguments his lawyers make in response to the Office of Congressional Ethics (OCE) report is that even if something bad did happen, Honda had no clue. His chief of staff, Jennifer Van der Heide, and longtime district director, Meri Maben, had a much harder time making that argument. But that’s why Honda’s campaign is also paying their attorney fees.

We’ve combed through the all of the documents and here are some of the biggest findings:

1. The “1,000 Cranes” project—1,000 donors each donate $1,000, which equals $1 million—was discussed at a September 2012 retreat in obvious quid-pro-quo terms. It also appears to be Congressman Honda’s own idea.

According to notes from the event provided to the OCE, the cranes project was not only mentioned as an idea of MH (i.e. Mike Honda), but that it “also will likely be transactional—i.e. help me with this visa for my grandma.” The notes add: “Donors are not going to be interested in the public affairs or the federal gov policy.”

Heystek told investigators that “there was no effort to create a transactional relationship with donors,” but the unedited retreat notes suggest exactly the opposite: “Lamar is here to try out this MH idea, even after the election for this to work, it will require MH to use his personal touch. [U]nlike a nonprofit, folks are not going to ante up every year because they believe in the cause.”

2. In her duties as Honda’s district director, Meri Maben, now with the Silicon Valley Education Foundation, helped one of the San Jose Sharks’ owners resolve an issue with acquiring a visa. The person requesting help on the owner’s behalf turned out to be none other than former San Jose Mayor Tom McEnery.

After helping McEnery, Maben tried to parlay that official work into campaign contributions. In an email to Honda’s fundraising consultant, Maben wrote: “I know we’ve tried with them before to no avail but once again we’ve responded to Tom’s request. Please ask Tom to come to birthday event and bring Sharks people. Woman below appears to be one of the owners.”

3. Some of Honda’s staffers recognized in the moment that House rules were being broken. In a private chat between two staff members, one employee notes that Mark Nakamoto is making campaign calls in the district office. The note recognizes such activity is “so illegal.”

4. The 2012 district retreat, which is considered part of official House work, included conversations about doing greater outreach to the Chinese community to specifically assist the campaign. Heystek, Honda’s former campaign coordinator, admitted to the OCE: “The district office doing Chinese language outreach was mentioned in the context of a campaign and votes.”

5. Multiple members of Honda’s House staff told OCE investigators that there was an expectation to work on the campaign, which again violates House rules. Workers should volunteer for such duties. One unidentified female staffer said that Jennifer Van der Heide, the chief of staff, was “usually the driver of these conversations and was pretty proactive in trying to get us engaged in that way.”

The staffer said that had she declined, “... I think that would have probably meant, though, that I needed to find a new job after that.”

6. Staffers were instructed to read a book by Ro Khanna, who lost a close race to Honda in 2014 and is challenging him again in 2016. Van Der Heide wrote an email with the subject line, “Required Reading, Entrepreneurial National by Ro Khanna.” She later told investigators that she was being “facetious” and no one was required to read the book, despite repeating those exact words in the body of the email.

A staffer disagreed with the chief of staff’s suggestion it was a joke. “I considered it part of my duties as someone that was working for Congressman Honda,” she said.

7. The email that really started all of this was a message from Van der Heide to Heystek, which linked invites to an official State Department Event to asking for campaign contributions. Ven der Heide wrote: “Great list. How are we doing outreach to them for $?”

An OCE investigator asked her, “What did you mean when you wrote that letter or wrote that line?”

Van der Heide answered, “I don’t know.”

Right…

8. Honda told investigators that retreats are “all official” business. When shown notes from Heystek’s presentation in 2012, as well as notes from an October 2013 retreat presentation from then-campaign manager Doug Greven, Honda admits improper coordination “did occur, I guess.” The OCE report has notes from Greven’s presentation that says policy will lead to district work, which is then parlayed into raising money for the campaign.

Honda says what we’re all thinking—“it doesn’t look good.”

9. The OCE recommended the House Committee on Ethics, which is carrying out the rest of the investigation, issue a subpoena for Doug Greven. Honda’s campaign manager for 2014 declined a request to meet with investigators, but he'll be under oath if compelled to testify. What he has to say could be the nail in the coffin.

10. Honda is going to have a huge hurdle in not only overcoming the damning details in the OCE report, but also convincing people to support him in the race to come. His challenger, Khanna, has apparently lined up a few new endorsements in San Jose Mayor Sam Liccardo, District Attorney Jeff Rosen and County Assessor Larry Stone.

  1. I don’t think Mike Honda will have any trouble with reelection. First, people who vote Democrat know that their representatives are corrupt, and have no problem with that. And Second, the Republicans will put up a candidate to run against Honda who will be so lackluster, that nobody will be aware of their existence.

  2. > First, people who vote Democrat know that their representatives are corrupt, and have no problem with that.

    It’s embedded in Democrat culture.

“He may be a sonofabitch, but he’s our sonofabitch.”

    — Franklin D. Roosevelt

  3. In other words, Reagan’s Iran-Contra defense (“These staffers! Who knows what they do when I’m out of the room!”) will be Honda’s go-to position, while his supporters will go into Nixon/Bonds/Armstrong fan mode (“Everybody does it!). Pay to play is the Honda way.

  4. “…his staff viewed official business as a commodity to be sold in exchange for campaign support.” Cynically, I think that nearly everyone believes that most of Congress operates this way. Pretty much only middle school civics students still look at Congress with any reverence.

“There’s also the issue of House staff routinely doing campaign work on taxpayer time.” I’m shocked…simply shocked!

  5. JOSH,
I’ve READ YOUR INTIRE POST, AND I SEE WAY TOO MUCH SPECULATION, COMING FROM YOUR EAGERNESS TO SABATOGE MIKE HONDA.
YOU WRITE, “(IF) DOUG GREVEN IS SUPOENAED,AND COMPELLED TO TESTIFY, UNDER OATH, WHAT HE HAS TO SAY (COULD) BE A NAIL IN THE COFFIN.”
ALL SPECULATION.ONCE AGAIN. SAN JOSE INSIDE HAS ATTRACKED A LOT OF FLYS!.
THERE IS A LOT AT STAKE HERE , COULD IT BE H-1B VISAS FROM INDIA. I HAVE A FEELING RO’S BACKERS FROM BACK HOME ARE ABOUT TO STACK THE DECK.
THIS HAS BECOME A VERY TRANSPARENT SOAP OPERA. ,IT HAS BECOME A BIT NAUSEATING, ESPECIALLY SINCE SAN JOSE HAS BEEN KNOW FOR IT’S SNAKE OIL MANAGERY..
OK!!, NOW, BACK TO MY ANVIL
    THE VILLAGE BLACK SMITH

WHILE I’M ON THE SUBLECT OF SABOTAGE. I WENT TO PETER’S BAKERY ON THE EASTSIDE. AND SIMPLY ASKED A LOT OF QUESTIONS ABOUT THIER PRODUCTS. EVERYONE I SPOKE TO WAS VERY CORDIAL AND FRIENDLY. THEY ARE VERY PROUD OF THEIR PRODUCT.THEY ALL SEEMED TO INVITE MORE QUESTIONS ABOUT MY INTEREST IN THEIR PRODUCT. EVERY ONE SMILED AND NOT ONE EXIBITED ANY DISTANCE. THAT WHEEL CHAIR BOUND RACIST, OWNER, NEEDS TO GO, BEFOER HE DOES KILL SOME ONE
I WENT NEXTDOOR AND BOUGHT SOME WESTER WEAR, AND WHEN AWAY WITH THE PLEASANT FEELING, THAT THERE ARE SO MANY FOLKS IN THIS NEIGHBORHOOD, THAT GIVE ME A SENSE OF FAMILY..

  6. This stuff is jaw dropping. I don’t see how anyone can stand by Honda at this point. The right thing for him to do at this point is resign.

  7. Kudos to Josh and the San Jose Inside for an outstanding job on covering this story since its inception. If they hadn’t been bold and reported these clear violations they learned from Mike Honda’s former staff member, Honda and his staff would still be failing their constituents and engaged in widespread corruption. It is unbelievable to me how out of touch these career politicians are. It’s nice to see that we are starting to see them exposed more. It will be interesting to see if Nancy Pelosi and other members of the establish continue to stand behind him. What a horrible black eye for the Democratic Party and the good people of the 17th District. It’s time for Mike Honda to resign and save everyone from further embarrassment. It’s not like he’s any effective member of Congress given that he’s only passed one bill (to rename a post office) in 15 years, not to mention that he’s been caught sleeping on the job at least 3 times on camera during the last two years. And I don’t think we need all capital letters to get that point across. I am disgusted with my so called congressperson. It’s time to clean House….literally.

  8. Excellent story, Josh. Luv’d da pictcha too of da tree Hawaiian bruddas flashin’ da hang loose sign. Dey look like da kine guys be givin large dollas to Martini Mike, da only dude in da pictcha wid a drink in his han’. Dat Mike, he shew know howta pahty good, yo.

So, has Meri Maben left as Martini Mike’s District Director? If so, what does that say?

Looks like you had an easier time getting the documents from the feds than you did getting Eddie Garcia’s emails from The City of SJ.

  9. JMO, AFTER READING YOUR COURT ROOM MELODRAMA, ABOUT CONGRESSMAN MIKE HONDA,
, I DECIDED TO FIND SOME THING THAT WOULD MAKE YOU AND JOSH LOOK LIKE THE $HIT THAT YOU ARE SPEWING.
I PUNCHED INTO THE BROWSER (,OFF SHORE CASH HELD BY APPLE).
THE FAMOUS WORDS OF MY GREAT GREAT GRAND FATHER, AS HE FOUGHT ALONG SIDE THE BRAVE IRISH MEN, OF LOS PATRICIOS. CAME TO ME!
ONE DAY THERE WILL BE NO MORE TO TAKE FROM US , AND THEN, THEY WILL BEGIN TO TAKE FROM EACH OTHER.
THESE MEN ONLY HAD A FEW BULLETS, AND THEIR INHERITED COURAGE. THEY FOUGHT WITH THE PRIDE OF HOPE!
HERE I AM , AFTER BUILDING SILICON VALLEY, IN THE MID 60’S, TO DATE. I SEE APPLE AS THE TAKERS OF THIS UNITED STATES. 181 BILLION, IN CASH.OFF SHORE.
NOT WANTING TO PAY THE 35% CORP TAX AS WE ALL HAVE, THEY ARE HOLDING OUT TO GET A TAX HIT THAT WILL BE SUBSTANCUALY LESS, BY BUYING THE POLITICIANS THAT WILL ACCOMPLISH THIS FOR THEM.
I FIND IT INTERESTING THAT RO, IS ALMOST A SILENT CANIDATE, ALLOWING HIS BOOTLICKERS TO RUN THE INTERFERANCE. JOBS, (APPLE) BEING THE LARGEST STOCK HOLDER OF DISNEY STOCK, HAS ALREADY REPLACE TECH ENGINEERS AT DISNEY WORLD IN FLORIDA., WITH H-IB WORKERS,SUPPLIED BY AN INDIAN COYOTE!. BRACE YOUSELVES FOR ,MORE OF THE SAME. IF RO GET IN, LOOK FOR INDIAN H-IB WORKERS TO REPLACE EVERY ONE YOU KNOW..

    • Village Black Smith, aka Gil Hernandez: Honda is beyond an embarrassment. The only reason you keep coming to his defense is that he stood up against lead poisoning in the Eastside. That may be the only good thing of importance that he has ever done. But now that he is under scrutiny from colleagues who ignore all but the most egregious ethics violations, what is your hero’s response? He’s throwing his staff under the bus, saying it’s all their fault. What a guy! :>( And why are you screaming? Is it because you haven’t a clue what all caps means, or that you don’t know how to cancel the Caps Lock?

  10. >I don’t see how anyone can stand by Honda at this point.

    I’ll show you how :-)

It’s clear there was an unethical merging of official business and campaigning and quid-pro-quo transactions, but if you think that this isn’t going with pretty much every other State Representative with nearly the same frequency then you are overly credulous.

It’s not clear to me that Mike Honda is significantly more unethical than the average representative. It seems entirely possible to me that he is only being investigated because the House Committee on Ethics was shamed into it by good reporting.

If Ro Khanna is elected I think he will view his constituents more as the enormous corporations that supported him and less the voters that elected him, and that gave me pause. Vinod Khosla? He’s a beach grabber, a thief of public property. Apple and Google collude to keep wages down for employees. The only reason that Ro Khanna’s hands are clean is because they haven’t held office yet.

That said, I was on the fence last time between Honda and Khanna, and narrowly chose Honda. I think it’ll be a little harder to choose Honda this time.

  11. More opinions about the Honda ethics report and I don’t they they will get any better. I’ve said it before and I will say it again, Congressman Honda has been a good representative for CA#17 in the past but it is time to pass the baton. He doesn’t know what is going on in his office and this is an embarrassment to him, his staff and our district. This is Silicon Valley. The world looks to us for innovation and leadership. We deserve better than this right now.

  12. JOHN MICHAIL OCCONOR, I LIKE ALL CAPS, I CAN READ THEM, DO I CARE IF THEY SIGNIFY SCREAMING1 OF COURSE NOT. IT’S YOUR GUILT NOT MINE.
BEING NAMED AND INCLUDED IN YOUR, AS ALWAYS CRITICAL POSTS, IS MUCH EXPECTED. AS LONG AS I HAVE KNOWN YOU , YOU HAVE BEEN NOTHING BUT THAT. YOU HAVE OBIOUSLY NOT LEARNED THAT CRITICIUM IS THE WINOW TO YOUR SADNESS AND GUILT.
HERE IS A GROUP HUG JMO.
YOU HAVE THE POWER TO CHANGE THE WORLD JMO. START WITH YOUR SELF TODAY.
THIS MIKE HONDA THING, IS NOT ABOUT A MAN , IT IS ABOUT THE NEW POWER GRAB, THAT IS ABOUT TO COME, CHINA WAS ONLY A TEST IN DOMINATION. $181 BILLION CASH OFF SHORE OF APPLE MONEY, IS BUT THE TIP OF THE ICEBURG.
YOU, WHO HAS ALWAYS GONE WITH THE BIGEST GORILLA IN THE ROOM. YES, GIVE IT A BANANA, BUT BRING SOMETHING ORIGIANLLY GOOD INTO THE ROOM.

  13. Previously, Congressman Mike Honda has been in office for about 14 years. In that time, he has sponsored one bill that has become law. This bill that became law is about naming a post office.Three times in the last two years he as fallen asleep [(1)at a Town Hall meeting that he was sponsoring, (2) on the House floor during government shutdown discussion, and (3) during discussions on challenge funding for the Department of Homeland Security.] Now, the Office of Congressional Ethics report recommendation for an investigation of the intermixing between his Congressional staffers’ duties and their reelection campaign work sheds more light on the reasons for Congressman Honda’s ineffective legislative record. We deserve a Congressman and District 17 Congressional Office staff who are solely focused and devoted to working to representing and improving the lives of the people of Silicon Valley. Congressman Honda and his staff actions are very troubling.

  14. AFTER BEING PERSONALLY CHALLENGED BY JOHN M. OCONNER. I DECIDED TO UNLOAD ON THE REASON I DEFEND MIKE HONDA ON THIS SITE. JOHN IS VERY CORRECT IN STATING THAT MIKE HONDA DID CHAMPION HIGH TOXIC LEAD POISONING IF BABIES AND YOUNG CHILDREN, ON THE EAST SIDE OF SAN JOSE. I HAD BEEN SCREAMING , AS A MAN OUT IN THE DESERT FOR 30 YEARS, BUT TO NO AVAIL. MIKE WAS ALREADY OUT THERE DOING HIS PART , BECAUSE HE UNDERSTUDE THE HORIBLE FACTS ABOUT TOXIC LEAD POISONING OF CHILDREN. THE POLITICIONS OUT THERE DID NOT GIVE A DAM, ABOUT ANY THING BUT THEM SELFS. NOW THEY HAVE ALL CRAWLED UNDER THAT ROCK..THE MEXICAN HERITAGE PLAZA AND GARDENS BECAME A POWER GRAB, BY THOSE WHO CONTROLLED IT.
NOW LET ME GET TO THE POINT OF MY POSTING THIS LABOR DAY MORNING. GREAT TIMING!
GO TO YOUR BROWSER, AND TYPE IN ,” RO KHANNA:SILICON VALLEY’S OWN(ED) MAN”.
SINCE THIS HAS BECOME A GAME OF SPECULATION, YOU WILL ENJOY THIS READ
RO , BRAGGED TO A NEW YOUK TIMES REPORTER, THAT THE DIFFERENCE BETWEEN HE AND HONDA
“I WEAR TECH GROUPE AS A BADGE OF HONOR” HE THEN FOLLOWED UP BY TELLING THE NYT, THAT HE FAVORED CHANGING AMERICA’S TAX CODE TO ALLOW TECH COMPANIES TO REPATRIATE THIER PROFITS WITHOUT BEING TAXED. THIS WAS NOT SPECULATION!!
APPLE ALONE, IS HOLDING 181 BILLION IN OFF SHORE CASH, BECAUSE THEY DO NOT WANT TO BE TAXED AT THE 35% WE ARE PAYING.
THEY ARE BACKING THIS PUPPET RO TO FEED THAT UGLY AMERICAN BEAST THAT IS LOOKING TO CHEAT IT’S WAY HOME. YOU DECIDE IF THAT IS SPECULATION, AFTER YOU READ HOW MANY BILLIONS ARE BEING HELD OFF SHORE BY THESE SILICON VALEY ELITISTS CORPORATIONS.
I SHAMES ME TO SEE THIS , BECAUSE I HAVE ENJOYED BUILDING THIS VALLEY OF INNOVATION, BY CREATING PROTO TYPE AFTER PROTO TYPE FROM ALL OF THOSE EARLY BRILLANT ENGINEERS, IDEAS.
I WATCHED BEHIND MY ANVIL AS THE FIRST WAVE THE JAPANESE CAME AND CAPTURED THE MARKET. WHAT FOLLOWED WERE THE TIWANESE, CHINESE , AND SO ON.
LAYING OFF HARD WORKING MEN, BECAUSE SO MUCH WAS GOING OVER SEAS WAS SADDENING.
MANY OLD CUSTOMERS TRIED TO COME BACK, AFTER THE CHINESE HAD THEM ON THIER KNEES, BUT I TURNED THEM AWAY. MY SON PAUL AND I CONTINED TO STRIKE THE ANVIL EVERY DAY. MAKING PRODUCT FOR HOMELAND SECURITY, AND HIGHLY TECHNICAL BRONZE CASTINGS. AND TRIBUTES OF BRONZE BAS REILIEFS TO MEN THAT EXCELLED IN OUR COMMUNITY.

    • Mr. Black Smith, I understand that you might love Mike Honda. That is your prerogative. What I don’t understand is your attacks on Ro Khanna. Over the last few articles and multiple times in this one, you make claims against Khanna that are false. Not even close. So I decided to take time on my Labor Day to politely correct you so you know to please not do this in the future.

      You say:
HE FAVORED CHANGING AMERICA’S TAX CODE TO ALLOW TECH COMPANIES TO REPATRIATE THIER PROFITS WITHOUT BEING TAXED. – that is only partially true. you forgot the most important part. He only favors this if strictly tied to job growth/hiring. Rather than just rattle off propaganda that Honda and his supporters say, I’d encourage you to review his platform yourself. If there’s something you disagree with, I’m sure Khanna would welcome your thoughts. http://www.rokhanna.com/issues/building-strong-21st-century-economy

“COULD IT BE H-1B VISAS FROM INDIA. I HAVE A FEELING RO’S BACKERS FROM BACK HOME ARE ABOUT TO STACK THE DECK…..IF RO GET IN, LOOK FOR INDIAN H-IB WORKERS TO REPLACE EVERY ONE YOU KNOW..” Khanna, like any other US politician, is only allowed to accept contributions from US Citizens and green card holders. The FEC is very strict about this so Ro does not have any “Indian backers”. When you say “Back Home” do you mean Philadephia where Ro was born or do you mean India as I fear. If so, that’s awfully racist. It’s compounded by your xenophobia about H1-B workers. I for one, believe that engineering immigrants helped make Silicon Valley great – Andy Grove, Sergey Brin, Elon Musk, Vinod Khosla.

You reference: “RO KHANNA:SILICON VALLEY’S OWN(ED) MAN”. I just checked….That’s a blog, sir. Written by a Honda supporter. Please reference something from a reputable media company.

And lastly, my personal favorite. You say:
“THEY (i.e, Apple) ARE BACKING THIS PUPPET”. You are correct. An apple employee (as an individual) has written him a check – ONE CHECK for $250 in 2011. Mike Honda, on the other hand, has 17 made over the last few years for approx $5000 (check opensecrets.org). Personally, I don’t think either is being backed by Apple. $5000 and $250 is not alot of money. I just wanted to give you the facts. Honda has 17x the number of Apple supporters than Ro.

Feel free to love Mike Honda. That’s your right. Feel free to buy him a drink, sing karaoke with him, etc. IMHO, you should feel free to find him his next job. He broke the law, he doesn’t deserve to represent Silicon Valley anymore.

  15. Thank you New dem, for that, response. I was quoting the New Your Times, from Ro’s own lips.
I’m very glad to have recieved you critcisums
I do not drink with Mike, and I don’t socialize with this proud and brave man. You failed to mention a word about the billions upon billions that these corporations are stacking
    Away, until the tax laws
    Are changed.
What ever Mike did or did not do. Ro Khanna, is in the pockets of all the companies. With billions and billions off shore !
I am glad I struck a nerve. This labor day. There is much more to this post. You have given me the desire to dig . As an American Foundryman. I know how to use a shovel. There is much about Honda you do not know. You and your Comrad’s are so transparent. Your critisisum is so revieling. No, I found Ro, Achiles heel, and it should be stated as such. MIKE has not been convicted of any wrong doing. But concider that local corporations want the repatriation tax to be dropped for then to 5%, instead , what is paid by local struggling corporations of 35%. Could that be concidered as UN American ? THINK BEFORE YOU SPEAK!
Now that I am being questioned by you, concider going back to your browser. Punch in

Your company looks like it’s doing some cool stuff.

I’m thinking of raising some money and commissioning a project.

Would your company be capable of creating a 25 foot tall bronze equestrian statue of Ronald Reagan with his horse trampling Jimmy Carter?

What kind of discount can you offer. Since it would be public art, could you do it pro bono?
