The Trump Administration's Title IX investigations team is targeting the California Community College Athletic Association, claiming that its ‘Transgender Participation Policy’ violates Title IX of the Education Act.

SJSU, the University of Pennsylvania and the Massachusetts high school athletic association are cited as violators of President Trump's Feb. 5 executive order banning transgender athletes. The N.C.A.A. changed its position immediately, citing the President's order.

A federal judge on Monday ruled that the San Jose State volleyball player, who is at the center of a controversy over transgender athletes, can participate in a women’s volleyball conference tournament this week. An appeals court judge today rejected an appeal of that ruling.

Changes are underway one year after scathing audits showed how the California State University system failed to handle reports of sexual discrimination, harassment and assault in its Title IX offices.

San Jose State University announced reforms of its Title IX enforcement efforts the same day that a new critical report was released.

The release of the report came on the day that jury selection began in the federal trial of former San Jose State athletic trainer Scott Shaw on federal civil rights charges, and also came less than a week after CSU trustees announced the appointment of a new chancellor, Mildred Garcia, effective Oct. 1.

Restorative justice is a controversial process that brings together the student who was harmed, the person who harmed them and the community to seek solutions.

Jason Hawkins resigned as San Jose State baseball coach in 2018, befoe he could be disciplined. Investigators found that he had violated CSU's anti-discrimination policies that are based on Title IX.  

The resignation of Sonoma State University President Judy Sakaki is the third in six months in the CSU system, where at least eight campuses are roiling with sexual misconduct controversies.

Lawyers filed a federal class action civil rights lawsuit this month on behalf of “Jane Doe et. al.” against Scott Shaw, San Jose State and CSU trustees citing “approximately 1,000 students” who may have been victims of Shaw's sexual abuse.

The next SJSU president will have to deal with lingering legal claims, and manage the wide-ranging reforms in its athletic programs required by the Justice Department settlement, not to mention dealing with issues of trust, reputation and accountability in the broader community.

A Scotts Valley nonprofit is set to tackle a $1 million Title IX investigation across Santa Clara County’s hundreds of K-12 and post-secondary schools, despite having neither college-level experience nor legal staff for the task. Education, Training and Research Associates is the intended awardee of a contract to assess and codify how educators countywide comply with state and federal laws on sex- and gender-based harassment and abuse, according to documents obtained by San Jose Inside. The decision will be final on June 10, if none of the other four bidding agencies protest the selection.

Title IX, a federal law, prohibits sex discrimination in educational institutions and outlines steps to protect students from sexual violence.

If the board OK’s the referral, county staff would report back to the board on the matter by the middle of November.
