Millions at Stake in Fight over Fire Safety Requirements for High Rise Buildings

For the last several months, a fight with multi-million dollar implications has quietly been waged over fire safety requirements in San Jose’s tallest buildings. The clash—featuring a tangled array of alliances between elected officials, developers, lobbyists, a monopolistic breathing device manufacturer, a union spurned and an ambivalent fire department—will come to a head Thursday afternoon, when the Public Safety, Finance & Strategic Support Committee meets to discuss the city’s tri-annual review of its fire and building codes.

Learning from Orange County’s Great Park

My journey through the new paradigm of San Jose’s parks and trails received another boost in the last month. Part of it came from a vacation to Montana, which always opens my eyes a bit and makes me reflect. But the biggest boost I received was from a tour of Los Angeles and Orange County parks.

Questions for Cindy

Judge Arthur Weisbrodt asked about corruption, dishonesty and backroom deals in a candidate’s debate two weeks ago. Oddly, he posed the question to Teresa Alvarado for not “taking on Cindy Chavez aggressively,” rather than ask Chavez directly. Debates with timed answers are too superficial to probe questions about complex financial relationships. So with one newspaper with its head in the sand, the other unable to get answers and an election opponent who avoided confrontation, the public has remained in the dark. Here are just a few of the questions that should have been asked.

Judge Booed for Chavez Remark

Judge Arthur Weisbrodt drew boos from a handful of San Jose Rotary Club members when he quoted an anonymous source as saying “I would tell the voters that voting for Cindy Chavez is the same as voting for George Shirakawa or Ron Gonzales. The same corruption, dishonesty and back deals.” Weisbrodt was moderating a debate last wednesday between Chavez and Teresa Alvarado in the runoff election to fill former county supervisor George Shirakawa Jr.’s seat.

Campaign Appeals for National Help

Former South Bay Labor Council head Amy Dean has sent out a national appeal to labor supporters, asking for financial support for supervisor candidate Cindy Chavez, according to an email forwarded to San Jose Inside. Dean, who formed Working Partnerships USA and mentored Chavez before moving to Chicago, writes that “The people of Santa Clara County need Cindy to have their back,” and asks recipients to “like” Chavez’s Facebook page if they can’t donate money.

County Launches ‘Reform Efforts’ Page

On Monday, a press release sent out by the Office of Pubic Affairs announced that County Executive Jeff Smith, “consistent with his word,” launched a webpage dedicated to “Reform Efforts.” This should solve everything.

Rules to Look at Renting Space at City Hall, Nonprofit Health Care Investigation

Parts of City Hall, left a bit empty after layoffs and the Redevelopment Agency’s closure, may soon be open to anyone looking to lease a slice of the swanky 18-story downtown centerpiece. Proceeds from the market-rate rents will go right to the city’s general fund, according to a memo going before the Rules and Open Government Committee on Wednesday. Other items include the Pete Constant-Johnny Khamis memo asking the city to investigate how public funds were used to fund a county sales tax measure carried out by organized labor.

Councilmembers Constant, Khamis Call for Investigation of Health Care Nonprofits

Two members of the San Jose City Council are calling for an investigation into whether city funds were illegally used in local campaigns. Councilmembers Pete Constant and Johnny Khamis are asking the city manager and city attorney to “investigate whether any city funds that were provided to either Santa Clara Family Health Foundation or VMC Foundation were used to fund any campaign activities in any manner,” according to a memo released Thursday. The memo notes that the city has given the foundations more than $6 million in the last three years.

Darcie Green Resigns from Santa Clara County Board of Education

Santa Clara County Board of Education member Darcie Green says she is resigning from the board “to avoid a long, messy legal battle to defend my seat.” Green was appointed to the board Oct. 17 of last year to fill a vacancy in Board Trustee Area 6, which was created by the resignation of Craig Mann. New district lines were drawn following Mann’s reelection in 2010. In making the appointment, the County Board relied on its legal counsel’s opinion, which turned out to be a mistake.

Shirakawa Pleads Guilty to All Charges

Hands loosely clenched, the thumb on George Shirakawa, Jr.’s right hand nervously rubbed back and forth across the inside of his index finger, as Judge Philip H. Pennypacker read the charges against the disgraced former county supervisor. “Guilty, your honor,” Shirakawa said Monday, announcing the same plea after each of the 12 criminal charges against him, which include five felonies—four for perjury and one for misappropriation of public funds—and seven misdemeanors.

Nonprofits Funded Labor Council Political Campaigns

Funds from two local non-profit health care foundations made their way to phone banks and mail campaigns of the South Bay Labor Council in 2012 after routing the money through a Measure A’s campaign committee. Both the VMC Foundation and the Santa Clara Family Health Foundation gave more than a quarter-million dollars each—a total of $539,000—to support an 1/8th cent county sales tax measure, Measure A. At least $90,000 of those monies were transferred to the South Bay Labor Council. An incestuous tangle of organizations, directors and consultants characterized the transactions, with common decision-makers on both the giving and receiving ends. None of the organization are willing to discuss how the funds were used and how decisions were made. Former San Jose vice mayor and South Bay Labor Council CEO Cindy Chavez currently heads up the nonprofit SBLC-linked Working Partnerships USA (WPUSA) and sits on the board for the Health Trust and Santa Clara Family Health Foundation.

Political theater, like a good novel or legend, needs strong central characters. Last Friday, we saw the district attorney ride in like Sir Lancelot, with Queen Guinevere by his side, to mete out a quick and final blow to the morally depraved Saxon,  in this case George Shirakawa, Jr.

If it were only that simple. The triumph of Good over Evil story line quickly morphed into a human tragedy as the county supervisor fell on his sword, resigned his position, agreed to plead guilty and attributed his betrayal of public trust to a gambling addiction.

East Side Union High School District Education Foundation Decertified by IRS

Last November, a few hundred people donned their best suits and gowns and converged on San Jose’s historic Hayes Mansion to toast some of the East Side’s most accomplished alumni. The stars that night, honored in the East Side Union High School District Education Foundation’s Hall of Fame fundraiser, consisted of a 10-person class led by Khaled Hosseini, a 1984 graduate of Independence High School and author of The Kite Runner. But on Nov. 15, 2011, the IRS revoked the foundation’s nonprofit status. And yet almost no one outside of its board—including donors—knew about its lost certification when it threw a fundraiser a year later.

Inside the Working Partnerships Political Money Machine

Working Partnerships USA, the labor-aligned nonprofit headed by former San Jose vice mayor Cindy Chavez, yesterday released its most recent Internal Revenue Service Form 990, after eight days of refusing requests to view the document. A review of the organization’s filings over the years found spending increases during key elections despite IRS restrictions on political activities by charities. In total, the nonprofit has raised and spent more than $25 million since 1998.
