Looks like Proposition 35 is already under fire after winning with a resounding 81 percent of the vote on election night. Prop. 35 increases penalties for human traffickers and requires those convicted of even a misdemeanor to report their Internet provider and user name to law enforcement. A judge blocked this part of the proposition after the ACLU and Electronic Frontier Foundation (EFF) filed a complaint.

Alum Rock Union School District trustees are making moves to fill a vacancy left by Darcie Green’s departure. School board watchers believe the existing majority has settled on one of two candidates: Patricia Martinez-Roach, who lost two elections this year; and Javier Gonzalez, who was passed over for a county education post. The apparent fast-tracking of the process has created a firestorm in the community.

California finally has the opportunity to be governable after last week’s election. For too many years the ability to set policy has been obstructed by a system that allows for minority veto.

San Jose Mayor Chuck Reed took a trip to Iowa this past weekend to speak with the state’s conservative governor and a taxpayer group about pensions.

Jim Unland looked exhausted on election night. But that fatigue didn’t last long after the Mercury News reported over the weekend that an upstart member of the police union named Jon Baker was questioning Unland’s leadership of the Police Officers Association.

Count Barbara Keegan among those most flabbergasted with her landslide victory last week for a seat on the Santa Clara Valley Water District board. But if it were up to the opinion editor at our local daily, Keegan would have pulled out of the race months ago. That would have allowed David Ginsborg, deputy to the county’s tax assessor, to easily claim retiring Joe Judge’s board seat. Barbara Marshman, the Mercury News’ editorial writer and decider of all things good and natural emailed Keegan in early August to try and cajole her into dropping out of the race.

An attorney with the county counsel’s office has provided San Jose Inside with a third, previously unreported audit of Supervisor George Shirakawa’s county charge card, also known as a P-Card. The audit shows that county officials were aware of Shirakawa’s free spending and disregard for county rules related to P-Cards as early as November 2009 — yet did nothing to stop the violations.

Election Day 2012 was good for public education in California and the nation. President Obama’s reelection means continued reform of public education through choice, quality early childhood education, meaningful teacher evaluation systems, pay for performance, career technical education and rethinking tenure. Proposition 30’s passage leads to a more stable publicly funded system of California schools.

The media has portrayed a polarized country by classifying states as either red or blue. If states were categorized by voting percentages rather than electoral votes, here’s how the United States of America would look. Everyone who had a stake in one of the local races on Election Night was asking the same question: For the love of god, what is taking so long for the results? OK, maybe that’s not exactly what everyone said, but it’s close.

Billions spent nationally, two years of nonstop campaigning and essentially nothing changed. But the outcome of Tuesday’s election will help the economy. Gov. Jerry Brown reigns supreme. People voted to tax themselves and Democrats have super majorities in the legislature. Happy days are here again!

“Please, just don’t talk to Cindy, OK?” begged a public relator at the South Bay Labor Council’s Election Night party when she spotted our operative. As people scarfed down tri-tip and fried chicken and frequented the open bar, U.S. Congressman Mike Honda kicked into an impromptu karaoke performance. SBLC CEO Cindy Chavez led cheers.

At 8:58 this morning, Robert Braunstein sent out a mass email congratulating Johnny Khamis on his victory. “The voters of District 10 made their choice,” he wrote. “I know Johnny will work hard on City Council to represent San Jose and this District well.”

In polarized San Jose, where unionistas have been battling pension reformers, both camps racked up victories and defeats, and neither was fully vanquished. As of early Wednesday morning, with two-thirds of the precincts in District 8 reporting results,  Councilmember Rose Herrera was gliding to a ten-point triumph over Jimmy Nguyen.

Tonight’s election night, which means San Jose Inside will attend whatever parties we don’t get thrown out of. I am writing this column as a pragmatic alarmist. This phrase is oxymoronic, but an accurate portrayal of how I feel at the end of my first term on the Santa Clara County Office of Education school board. It is Election Day 2012. Four years ago, 60 friends and supporters watched the returns with me at my election night party. We celebrated the national results along with my election to the county Board of Education. Little did I know that the Board would be at eye of the political storm brewing over charter school expansions.
