Pillow Maker Pays $1 Million to Settle False Advertising Lawsuit

A pillow company that claimed to ease symptoms of sleep apnea, fibromyalgia, insomnia and migraines agreed to pay more than $1 million to settle a false advertising lawsuit filed by Santa Clara and seven other California counties.

My Pillow trotted out testimonials that lacked any basis in science, according to the suit filed against the Minnesota-based manufacturer in Alameda County Superior Court.

The company agreed to pay $995,000 in civil penalties and $100,000 to charities that offer shelter to domestic violence victims and the homeless. My Pillow is also prohibited from making claims that their products can cure or treat any diseases unless they conduct a human trial to prove it.

“We will hold accountable companies that make false claims to get consumers to buy their products,” Santa Clara County District Attorney Jeff Rosen said in a statement.

The DA’s Office is part of a multi-agency task force that keeps an eye out for false and misleading advertising claims, he added. My Pillow not only pitched its products as the cure-all for a range of disorders, according to the complaint, it also called itself the “Official Bed Pillow” of the National Sleep Foundation without disclosing the financial connection between the two.

Santa Clara County will get nearly $100,000 of the civil penalty assessment, which the DA’s Office plans to use on enforcing consumer protection laws. Some $10,000 of the charitable proceeds agreed to in the settlement will go to the YWCA Silicon Valley, Asian Americans for Community Involvement, Community Solutions and Next Door Solutions to Domestic Violence.

  2. So where is my money? Where’s the class action lawsuit info? Did the state only file suit to fill their pockets? Where is the clause in the suit that protects and educates the public on My Pillow claims?

    My Pillow should have sent the money to the Clintons and called themselves the “Official Bed Pillow” of he Clinton Foundation.
