San Jose Judge Drops All But One Claim in Trump Rally Lawsuit

A judge this week dropped three of four charges in a lawsuit filed by Donald Trump backers against the city of San Jose, according to news reports.

The lawsuit accuses San Jose police of failing to protect people were chased and assaulted by protesters on their way out of a June 2 campaign rally in downtown. Rally attendees leaving the event say police clad in riot gear stood idly by as protesters attacked them.

Mayor Sam Liccardo and police Chief Eddie Garcia have denied the allegations. The lawsuit also suggests that the mayor’s party affiliation—he’s a registered Democrat and Hillary Clinton supporter—affected the city’s response.

According to the Mercury News, the city asked the judge to dismiss the case, which was filed on behalf of 14 plaintiffs by attorney and Republican National Committee official Harmeet Dhillon.

U.S. District Judge Lucy Koh let the claim of negligence stand and set a date for a jury trial in 2018. She also gave Dhillon another month to amend her complaint and drum up more evidence.

For more than a year, Trump’s campaign for the presidency has been dogged by violence. Rallies throughout the nation have erupted in fistfights between Trump supporters and people protesting the Republican candidate’s divisive rhetoric.

This past week, however, the allegations of assault have been leveled against Trump himself. Several women have come forward claiming that the GOP nominee sexually assaulted them over the years.

Many of them spoke up after hearing a 2005 audio recording of Trump boasting about groping and forcibly kissing women. In the hot-mic recording, Trump brags that he can touch women without permission and “grab them by the pussy” because of his fame.

  1. I was there and the police only took action if a Trump supporter reached the police line for help and the assaulters came toward police. Then police pushed forward to protect their own. Then they told the assaulted to move on where they were again chased and hit.

  2. Isn’t funny how sexual assault allegations only seems to come out in October every 4th year?
    Oh wait I remember Hillary a Bill screwing us all for the last 23 years, but that never counts.

      Your assessment is accurate beyond what you may realize. No real cop would put up with such inaction and I doubt any senior sergeant would put up with it either. In fact, during the riots following the Rodney King verdict in 1992, it was a senior sergeant who finally got fed up and gave a dispersal order to clear out the crowd downtown. The command officer(s) in charge (who was on a promotions list at the time, as I recall and apparently didn’t want to soil himself with potential controversy) was paralyzed with indecision and did nothing while windows were being smashed out, property was being vandalized and bottles were being thrown.

      The sergeant gave the dispersal order, the crowd was cleared out without any significant violence and the problem evaporated along with any respect the cops had for (most but not all of)their command staff. I know of one senior patrol officer who received formal discipline for voicing his disgust at the timidity of command officer(s) who failed to action.

      The following day, then (deputy or assistant?) chief Lansdowne told a briefing room full of cops, most of whom had been in the skirmish line the night before: “I had to let it (the riot) get enough out of hand that the press wouldn’t criticize us too much for shutting it down, especially if we had to use force”.

      You are correct sir, no real policeman and no real sergeant would have failed to act but the timidity of those “career climbers” above the rank of sergeant (not all but many) should never be underestimated.

      Also, I love the look on the face of that girl wearing the jersey in the photo. I may have it made into a poster. If I knew who she was, I would take her to a nice dinner at The French Laundry restaurant in Yountville.. There’s nothing more attractive than a spunky young lady.

        You’re assuming facts not in evidence. Ever since John Roberts, Bruce Jenner, and James Comey flipped (each in their own way), we can’t presume anything. Are you certain it’s a ‘she’?

        But the ‘young lady’ can easily verify her ‘gender’. There’s the time-tested way…

        Next, re: John Kracht: police orders certainly were conveyed — unless you believe that all the cops decided on their own, and at the same time, to allow the anti-Trump contingent (many of whom were bused in from the Central Valley) to barge into the area that had been reserved, in advance, for their 1st Amendment assembly/meeting.

        No sane cop would deliberately allow those two groups to come into contact. But that’s exactly what was done. And it fits a clear pattern. For example, when there was spirited bidding for the last few votes that were needed to pass Obamacare, I strongly suspected collusion.

        Then, when SCOTUS chief John Roberts was flipped on the Obamacare vote (astonishing everyone on both sides), I knew they’d either found a skeleton in his closet, or they found something Roberts craved enough to trade a vote for (most likely a combination of the two), and then…

        When it came out that FBI Director James Comey had taken piles of money from the Clintons in the past…

        …ask I ask myself: how hard would it be to get a message to the San Jose mayor and police chief?

        You don’t have to be a cop to understand that keeping those two groups well separated is basic common sense. But common sense can easily be trumped by…

        Money! Moneymoneymoneymoneymoney…

        And if lotsa money doesn’t work, there’s always a trumped-up allegation or two that would be carried as fact by the subservient Clinton-tamed media (like the women who recently appeared for the very first time, accusing Trump of doing what they wished he’d actually done).

        The media can easily make up insinuations that result in a big hit to someone’s credibility, even if they’re refuted later (eg: Trump). The Chief Justice cannot have a cloud like that over him.

        So for whatever reason, Roberts was flipped like so many before him. They got to him, and he caved. And now James Comey has assumed the role of the Department of Justice, pre-announcing that there is insufficient evidence to charge HRC…

        It isn’t the FBI’s job to bring charges! Or to dismiss charges, as Comey obviously did. That’s the prosecutor’s job. The FBI simply investigates. They collect and collate evidence. They make arrests (sometimes). They assist the prosecution (if there is one).

        But the FBI does not announce a Justice Department trial verdict in advance! That was only done to give cover to the country’s top cop, Loretta Lynch. So now she can pretend there is no way to charge Ms. Hillary for doing things that would land you or me in a federal penitentiary for a long time. Because, you see…

        She’s SPECIAL. We’re not. Laws are for the little people, like us.

        The legal term is a “racket”. Director Comey should be investigating the Clinton racket. But they got to Comey, so the perpetrator is free as a bird now. Do you like that? The little people don’t.

    Crimes and conspiracies were were committed in San Jose against San Jose citizens. Where is the Grand Jury?
